GMO – Decision by the ECJ on French Mon810’s ban

In February 2010, the Conseil d’État (Council of State, the highest administrative Court of France) made use of the preliminary ruling procedure to put three questions to the Court of Justice of the European Union (ECJ). The main purpose of these questions was to determine if the French moratory on the maize Mon810 is legal or not. The decision of the Court partially invalidates the French moratory. For the French government, the decision is only based on procedural reasons but « the environmental concerns are still there ». Through its Minister of Environment the government already announced its intention to issue a new safeguard clause if necessary
